By selecting this option, I affirm that I qualify under one of the following categories and agree to abide by the conditions outlined in this agreement:
- A local, state, regional, or federal agency involved in historic preservation under provisions of the National Historic Preservation Act of 1966, as amended [16 U.S.C. 470], and other applicable local, state, and federal laws and regulations.
- A private entity involved in historic preservation under provisions of the National Historic Preservation Act of 1966, as amended [16 U.S.C. 470], and other applicable local, state, and federal laws and regulations.
- An academic researcher affiliated with an accredited educational or research institution.
As a representative of the undersigned organization, I do hereby request access to the State Historic Preservation Office Cultural Resource Data. In consideration of access to this information, I agree with the following:
- I understand that the State Historic Preservation Office may, under Section 304 of the National Historic Preservation Act, withhold from public disclosure information that may cause a significant invasion of privacy, risk harm to the historic place, or impede the use of a traditional religious site by practitioners. Accordingly, I agree that information released pertaining to the location of archaeological sites and address-restricted National Register listings will be considered confidential and will not be disclosed to individuals, companies, or agencies not directly and necessarily involved with the projects about which this research is being conducted.
- I further agree to provide notice to the Ohio History Connection of any public records request I receive pertaining to these data so that the Ohio History Connection may assess that request for risk under the terms of Section 304 of the NHPA.
- I will identify the State Historic Preservation Office as the data source on any map, image, or publication using State Historic Preservation Office data. I will also include on the map, image, or publication the date that data were provided by the State Historic Preservation Office.
- I understand that although the State Historic Preservation Office maintains high standards of data quality control, the State Historic Preservation Office makes no warranty that the data are accurate or complete.
- I understand that obtaining information on previously recorded historic properties does not constitute review or comment under Section 106 of the National Historic Preservation Act. If a project is federally funded, licensed, permitted, or assisted, I understand that the federal agency may require me to obtain a comment on the State Historic Preservation Office under Section 106.
- I understand and acknowledge that the accuracy of these data is time-limited.
- I indemnify and hold the State Historic Preservation Office and Ohio History Connection, and its officers and employees, harmless against any claims by third parties arising out of the use by me of the data provided hereunder.
- I understand that this agreement is the entire agreement between the parties with respect to the subject matter hereof and may be amended only in writing signed by both parties.
- I will report any change of address or status to the State Historic Preservation Office within 30 days of such a change.
- I understand that failure to comply with the terms of this agreement may result in loss of access privileges.
